In 2025, the DLCD proposed rules that would have made it harder for small and medium farms in Oregon to stay in business. Oregonians spoke up, and the Governor listened—temporarily pausing that rule making process. Now, HB 4153 offers the permanent solution we've been waiting for.

What is HB 4153?

HB 4153 is a bipartisan bill introduced in the 2026 Legislative Session designed to champion and protect farm stands and agritourism.

This bill is a direct result of the public outcry to save our farms. Oregonians value buying food locally, supporting small family farms, and sharing on-farm experiences. What HB 4153 Does For Oregon Farms Like Ours

Current Oregon law places outdated barriers on farm stands and agritourism. HB 4153 modernizes and clarifies those rules so farms can operate with confidence while remaining sources of local food and community connection.

Protecting what you love most

Today, what farms are allowed to do varies by county and isn't consistent across the state. HB 4153 explicitly allows events and activities such as:

  • Educational field trips and classes
  • Harvest festivals promoting farm products
  • Sales of products from local farms
  • Tents and farm buildings for guest comfort
  • On-site food and beverage preparation and sales
  • Farm-to-table dinners
  • Play structures and hay slides for children
  • Hayrides and corn mazes

Ending Income Restrictions

HB 4153 removes restrictive income limits on agritourism and retail sales, allowing farms to:

  • Diversify revenue streams and remain viable
  • Keep agricultural land in production

A Balanced, Common-Sense Approach

This bill was developed with input from farmers, advocates, and county officials. It ensures Oregon farms can continue operating and offering the experiences families love—while including safeguards that respect local communities. Counties retain authority over:

  • Traffic Management: Ensuring rural roads aren't overwhelmed.
  • Safe Egress & Access: Safe entry and exit for families.
  • Designated Parking: Keeping cars off shoulders or on-site.
  • Noise & Sanitation: Respecting the peace and quiet of rural neighbors.
